Provincial courts officially have the authority to review and re-trial cases from July 1

From July 1, the provincial People's Court has the authority to resolve, according to the appellate procedure, cases in which judgments and decisions of the regional People's Court that have not yet taken legal effect are appealed or protested; to review and re-trial judgments and decisions of the regional People's Court that have taken legal effect but are protested according to the provisions of the 2015 Civil Procedure Code.

The Law amending and supplementing a number of articles of the Civil Procedure Code, the Administrative Procedure Law, the Juvenile Justice Law, the Bankruptcy Law and the Law on Mediation and Dialogue at Court has just been passed by the National Assembly at the 9th Session of the 15th National Assembly. This Law will officially take effect from July 1, 2025.

Notably, Clause 4, Article 1 of the Law amending and supplementing a number of articles of the Civil Procedure Code, the Administrative Procedure Law, the Juvenile Justice Law, the Bankruptcy Law and the Law on Mediation and Dialogue at Court amending Article 37 of the 2015 Civil Procedure Code stipulates the jurisdiction of the provincial People's Court.

Specifically, the provincial People's Court has the jurisdiction to resolve cases in which the judgments and decisions of the regional People's Courts that have not yet taken legal effect are appealed or protested; review and re-trial of judgments and decisions that have come into legal effect of the People's Court of the region but are protested according to the provisions of the Civil Procedure Code 2015.

The People's Court at the provincial level has the authority to resolve requests to annul arbitration awards and register arbitration awards in accordance with the provisions of the Law on Commercial Arbitration.

Currently, Article 37 of the Civil Procedure Code 2015 stipulates the jurisdiction of the People's Court at the provincial level as follows:

The People's Court at the provincial level has the authority to resolve the following cases at first instance:
- Disputes on civil, marriage and family, business, trade, and labor as prescribed in Articles 26, 28, 30 and 32 of the Civil Procedure Code 2015, except for disputes under the jurisdiction of the People's Court at the district level as prescribed in Clause 1 and Clause 4, Article 35 of the Civil Procedure Code 2015;
- Civil, marriage and family, business, commercial and labor requests specified in Articles 27, 29, 31 and 33 of the 2015 Civil Procedure Code, except for requests under the jurisdiction of the District People's Court specified in Clause 2 and Clause 4, Article 35 of the 2015 Civil Procedure Code;
- Disputes and requests specified in Clause 3, Article 35 of the 2015 Civil Procedure Code.

The Provincial People's Court has the authority to resolve at first instance civil cases under the jurisdiction of the District People's Court specified in Article 35 of this Code that the Provincial People's Court itself takes up for resolution when deemed necessary or at the request of the District People's Court.

Thus, from July 1, 2025, the Provincial Court officially has the authority to review and re-examine judgments and decisions that have come into legal effect of the Regional People's Court but have been protested in accordance with the law.
